Village Yoga, LLC - Terms of Service Agreement
Effective date: March 30, 2026
1. Introduction
Welcome to Village Yoga Santa Cruz ("Studio", "we", "our", or "us"). These Terms of Service ("Agreement") govern your use of our services, classes, facilities, website, and any related offerings (collectively, the "Services"). By purchasing, booking, or attending any class or service, you agree to be bound by this Agreement.
2. Eligibility
You must be at least 18 years old to participate in classes without parental consent.
Minors must have a parent or legal guardian sign a waiver prior to participation.
3. Health & Safety Acknowledgment
By participating in our Services, you acknowledge that:
* Yoga and fitness activities involve inherent risks, including injury, illness, or death.
* You are physically fit and have no medical condition that would prevent safe participation.
* You agree to inform instructors of any injuries, limitations, or pregnancy prior to class.
You voluntarily assume all risks associated with participation, whether known or unknown.
4. Waiver & Release of Liability (California-Specific)
To the fullest extent permitted by California law, you agree to release, waive, discharge, and hold harmless Village Yoga, LLC, its owners, instructors, employees, contractors, and agents from any and all liability, claims, demands, or causes of action arising out of or related to your participation in the Services, including those arising from ordinary negligence.
This waiver is intended to be as broad and inclusive as permitted under the laws of the State of California. If any portion is held invalid, the remainder shall continue in full legal force and effect.
5. Memberships, Packages & Payments
* All class packages and memberships must be paid in full prior to use unless otherwise specified.
* Packages are non-transferable and non-refundable except as required by California law.
* Expiration dates apply to all packages and will not be extended except at the Studio's discretion.
* Memberships may automatically renew unless canceled in accordance with the cancellation policy.
* The Studio reserves the right to change pricing with reasonable notice.
6. Cancellations & No-Show Policy
* Classes must be canceled at least 2 hours in advance.
* Late cancellations or no-shows may result in forfeited class credits or fees.
* The Studio reserves the right to cancel or reschedule classes
7. Code of Conduct
To maintain a safe and welcoming environment, you agree to:
* Arrive on time and respect class schedules.
* Treat instructors and fellow participants with respect.
* Refrain from disruptive, abusive, or inappropriate behavior.
* Clean/mop up the sweat around your mat. Use two-three towels if needed during class.
The Studio reserves the right to refuse service or terminate membership for violations of this policy.
8. Marketing, Communications & Consent (California & Federal Compliance)
By providing your contact information and using our Services, you acknowledge and agree to the following:
8.1 Email Communications
* You consent to receive transactional and marketing emails from the Studio, including class updates, promotions, and events.
* You may opt out of marketing emails at any time by clicking the "unsubscribe" link in any email or contacting us directly.
8.2 SMS/Text Messaging (TCPA Compliance)
* By providing your phone number, you expressly consent to receive text messages (including via automated systems) from the Studio for scheduling, reminders, and promotional purposes.
* Message and data rates may apply.
* Consent is not a condition of purchase.
* You may opt out at any time by replying "STOP" to any message.
8.3 California Consumer Privacy Act (CCPA/CPRA) Notice
If you are a California resident, you have the following rights regarding your personal information:
* The right to know what personal data we collect and how it is used.
* The right to request deletion of your personal data.
* The right to correct inaccurate information.
* The right to opt out of the sale or sharing of personal information (Note: the Studio does not sell personal information).
* The right to non-discrimination for exercising your privacy rights.

8.4 Use of Photos, Video & Likeness
* The Studio may capture photographs or video recordings during classes or events.
* By participating, you grant the Studio a perpetual, royalty-free, worldwide license to use your image, likeness, and voice for marketing, promotional, and advertising purposes (including social media, website, and print materials).
* If you do not wish to be photographed or recorded, you must notify the Studio in writing prior to participation.
8.5 Data Collection & Usage
We may collect personal information including name, email, phone number, payment details, and usage data for the purposes of:
* Providing and improving Services
* Processing payments
* Customer support
* Marketing and analytics
We implement reasonable security measures to protect your information but cannot guarantee absolute security.
9. Privacy Policy
We respect your privacy. Personal information collected will be used to provide Services, process payments, and communicate with you. We do not sell personal data. Additional details may be outlined in a separate Privacy Policy.
10. Intellectual Property
All content provided by the Studio, including logos, branding, class formats, and materials, is the property of Village Yoga and may not be used, reproduced, or distributed without permission.
11. Facility Use & Personal Belongings
* You agree to use the Studio facilities responsibly.
* The Studio is not responsible for lost, stolen, or damaged personal items.
12. Dispute Resolution (California)
Any dispute arising out of this Agreement shall be resolved through binding arbitration in the State of California, in accordance with the rules of the American Arbitration Association, unless otherwise required by law. You waive the right to participate in class action lawsuits to the extent permitted by law.
13. Termination
We reserve the right to suspend or terminate your access to Services at any time for violation of these Terms or for behavior deemed unsafe or inappropriate.
14. Changes to Terms
The Studio may update these Terms at any time. Continued use of Services after changes constitutes acceptance of the updated Terms.
15. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California.
